FAQs
Questions people actually ask us.
Straight answers about conveyancing in South Australia. Can't find yours? Just ask.
What does a conveyancer actually do?
A conveyancer manages the legal side of transferring property ownership. That includes preparing and reviewing contracts and Form 1 statements, conducting title and government searches, liaising with your bank and the other party, adjusting rates and taxes, and attending settlement on your behalf so ownership passes to you correctly and on time.
When should I engage a conveyancer?
Ideally before you sign anything. Having your conveyancer review the contract and Form 1 before you commit means issues like easements, encumbrances or unclear special conditions are caught early. If you have already signed, engage a conveyancer as soon as possible, because cooling-off periods in South Australia are short.
How long does settlement take in South Australia?
Most residential settlements in SA occur 4 to 6 weeks after the contract is signed, though the timeframe is set by the contract itself. We track every deadline, keep you informed at each stage, and coordinate with all parties so settlement happens on the agreed date.
What is a Form 1 statement?
The Form 1 (Vendor’s Statement) is a legally required disclosure document in South Australia. It sets out details about the property, including title, encumbrances, charges, zoning and other prescribed matters, and must be served on the purchaser before settlement. It also triggers the purchaser’s cooling-off rights, so it must be prepared and served correctly.
What is the cooling-off period in SA?
For most private treaty residential purchases in South Australia, the purchaser has two clear business days after being served the Form 1 to cool off and withdraw from the contract. Cooling-off rights generally do not apply when buying at auction.
Do I need a conveyancer if I am selling, not buying?
Yes. Sellers must have the Form 1 prepared and served correctly, respond to purchaser requisitions, discharge any mortgage, and complete settlement. Errors in the Form 1 can give the purchaser extended rights to walk away, so professional preparation protects your sale.
What is electronic settlement?
South Australian settlements are completed electronically through the PEXA platform. Funds and title transfer happen digitally on the day of settlement. It is faster, more secure, and there is no need to attend in person. We manage the entire electronic workspace for you.
How much does conveyancing cost?
Costs vary with the type and complexity of the transaction. A straightforward purchase differs from a land division or SMSF transfer. Contact us for a clear, no-obligation quote up front, so you know exactly what to expect with no hidden surprises.
